The Honorable Stephen P. Friot, United States District Judge for the Western District of Oklahoma will hear arguments in the case of Ward Et. al. v. HealthSouth Et. al. in the Homsey Moot Courtroom on Feburary 16, 2006 at 2 pm. Selected court documents are available online and at the Law Library Circulation Desk.

The OCU Family Law Association will be hosting Special Judge Michael E. Chionopoulos Thursday evening at 5PM. Judge Chionopoulos was sworn in as a special district judge for Oklahoma County District Court, where he hears domestic cases. Judge Chionopoulos is a veteran of the JAG Corp for both the U.S. Army, where he completed a tour of duty in the Middle East in 2003, and the U.S. Air Force. Judge Chionopolous is a 1992 alumnus of OCU Law.
We will also be making arrangements for students to be able to sit through motion dockets, VPO dockets and trials on the ‘domestic’ floor of the courthouse.

Mr.Valdez graduated from the University of Oklahoma School of Law and has practiced law for over 25 years.

Mr. Rodriguez currently works as a federal prosecutor for the Antitrust Division and has recently been named as one a regional recruiter for the U.S. Department of Justice in Dallas, Texas. He graduated from OCU LAW in 2002 with honors where he was very active in the student bar association. He attended Cameron University in Lawton, Oklahoma and majored in political science. Before entering Cameron University, Juan served three years in the U.S. Army as a field artillery surveyor.

David May, an OCU professor of economics, will speak on “Does government promote conservation? Tales from the oil patch.”
State governments have enacted many laws to promote conservation of oil and natural gas, among them the so-called “forced pooling” acts that require adjacent land owners of a “common reservoir” to join in drilling wells if one of them, but not all, wishes to. This reportedly leads to conservation of natural resources by having fewer unnecessary wells drilled. All oil producing states have these laws except Texas.
May’s presentation will look at what happens when comparing the drilling and production records of Texas to that of an adjacent state. Does Texas, without forced pooling, have more wells drilled? And does production occur at a more wasteful rate than Louisiana, with forced pooling?
May’s research of the oil and natural gas industry is based on 15 years experience as a professional landman. It focuses on the practical applications of economic theory related to pooling and unitization questions, retail pricing and divorcement, dealer versus company-owned station competition and other issues. May earned his bachelor’s from the University of Oklahoma and his master’s and doctoral degree from Florida State University.

Robert A. Levy is a Senior Fellow in Constitutional Studies at the Cato Institute. He was the Senior Editor of The Heritage Guide to the Constitution, which provides the first ever line-by-line examination of the complete Constitution and its contemporary meaning.

The ceremony begins at 2:00 p.m. at Crossings Community Church, 14600 North Portland, and lasts 2-2 ½ hours. Graduates must be present no later than 1:40 p.m. to line up. You should try to get there earlier if you are riding with family and friends. This ensures that your loved ones will obtain the best seats (and parking) possible. A student usher will direct you to the graduates’ robing area. You must BRING YOUR HOOD along with your cap, gown, and tassel in order to participate in the ceremony. Once in the robing area, you will need to complete a card from the photographer that you will carry with you so that your name can be called and your photo taken as you cross the stage.
During the ceremony, after the speaker’s address, Tom McDaniel, President of OCU, will confer the Juris Doctor degrees. You will then be “hooded;” i.e., a faculty member will place your doctoral hood over your head so that it hangs from around your neck behind you. One by one, each graduation candidate will have his/her name called as he/she walks across the platform to be hooded. After you are hooded, turn and face the audience as you shake the dean’s hand. Your photo is taken at that moment by Candid Color Photography. A proof of that photo will be mailed to you.

This year's Legal Affair will recognize two outstanding former Oklahoma City University School of Law professors, Marjorie Downing and Nancy Kenderdine.
Proceeds from the dinner will fund endowed scholarships named for these women, who have influenced hundreds of students of law at OCU LAW.
Also to be honored is Reta Strubhar, formerly of the Oklahoma Court of Criminal Appeals, who will be presented with the 2006 Marian P. Opala Award for Lifetime Achievement in Law.

I am the new Director of Academic Achievement at OCU. One important and exciting aspect of my job is to help you "Conquer the Bar."
I taught, previously, at the University of Missouri at Kansas City School of Law. My responsibilities included organizing the supplemental bar preparation program and helping students with their bar exam preparation.
We achieved some remarkable results, including achieving the top bar passage rate in Missouri for 2 of 5 bar exams administered during the past three years. One of the ways that we succeeded was to organize and assist our graduates. To do this, we emphasized the importance of meeting with me and participating in supplemental bar subject workshops anjd lectures taught by myself and other members of the faculty. UMKC students who participated in our program passed the bar exam at a much higher rate than those students who elected not to participate.
I am pleased to announce our first informational Conquer the Bar meeting on Wednesday, August 30th from 4:00 to 4:45 p.m. in the large courtroom.
If you are graduating in Dec 2006 or May 2007 and planning to take bar exam in February or July 2007, I highly recommend that you plan to attend this meeting.

Joe S. Rolston IV is the General Counsel for Oklahoma City based W & W Steel, one of the largest steel fabricating companies in the United States. Mr. Rolston was formerly General Counsel and Corporate Secretary for Marnell Corrao Associates in Las Vegas, Nevada, a provider of Architecture, Construction, Interiors, Master Planning, Consulting and Development services, whose past hotel/casino projects included The Bellagio, The Mirage, Treasure Island, and the new Wynn Resort. Prior to that Mr. Rolston served as Executive Vice President, General Counsel and Secretary of PDS Gaming Corporation. Before joining PDS, Mr. Rolston was the Associate General Counsel and Executive Director of Compliance for Mikohn Gaming Corporation (now Progressive Gaming). Mr. Rolston joined Mikohn after serving as Deputy Attorney General for the State of Nevada where he represented the Nevada Gaming Commission, State Gaming Control Board, Nevada Athletic Commission, Real Estate Division, and Financial Institutions Division, among others. Mr. Rolston was one of the attorneys who represented the State of Nevada in the administrative hearing to revoke Mike Tyson’s boxing license back in 1997. Mr. Rolston also holds an Associate in Risk Management (ARM) designation from the Insurance Institute of America and has been recognized as a Designated Design-Build Professional (DBIA) by the Design-Build Institute of America. Mr. Rolston received his undergraduate degree in Business Administration (Marketing / Economics) from Oklahoma State University in 1986 and his Juris Doctor degree from Oklahoma City University School of Law in 1989. Mr. Rolston is licensed to practice law is both Oklahoma and Nevada.

Susan Witt Conyers' experience will be beneficial for those seeking administrative, governmental or judicial positions. Conyers served as a member of the Oklahoma Workers’ Compensation Court from 1994 to 2006. Prior to this Jusge Conyers served as General Counsel and Deputy Counsel to the Office of the Governor and as a member of the Board of Managers of the Oklahoma State Insurance Fund (now known as CompSource Oklahoma). Prior to this period of state service, she was engaged in the private practice of law. In 2006 she elected not to stand for reappointment to her judicial position and now serves as Staff Attorney to Judge Larry Joplin on the Oklahoma Court of Civil Appeals. She received her JD from the University of Oklahoma College of Law.

INTERESTED IN FAMILY LAW?
Family Law is something most of us who intend on going into private practice will want to know more about. OCU’s Family Law society avails students of the opportunity to meet different role players which will greatly affect their practice. At our meetings, we will give you the opportunity to interact with family law judges, guardians ad litem, well-known attorneys, counselors, and other important role players within the family law system.
Our first meeting, which will be held in ROOM 104 tomorrow at 5PM will feature nationally recognized psychologist and expert in the area domestic violence, anger management and sexual offender programs, Dr. Richard Kishur.
Dr. Kishur began to work as a counselor with the Veterans Administration “Vet Center” Program in Oklahoma City in 1984. In addition to counseling veterans and their families, he began to develop anger management, domestic violence and sexual offender programs. In 1989 he developed the comprehensive sexual offender treatment program for medium and low security inmates of the Oklahoma Department of Corrections. His program was showcased in a segment of the CBS news magazine “48-Hours” in 1991. He developed a model community-based sexual offender treatment program in 1992 and left the Department of Corrections to enter full time private practice in 1993. He published his treatment program in 4 books in 1992 and that program is now in use throughout the United States. Dr. Kishur provides specialized treatment to clients with many different kinds of sexual behavior problems. He conducts forensic evaluations and consults with defense attorneys and prosecutors on criminal cases. Dr. Kishur also provides training in sexual offender treatment throughout the United States.

Oklahoma City University will commemorate the 219th anniversary of the signing of the U.S. Constitution on Monday, Sept. 18 with several Constitution Day events. The constitution was signed Sept. 17, 1787.
OCU Law School Professor Dennis Arrow will give a lecture on "The Doctrine of Original Intent" at 11:30 a.m. Sept. 18 in Walker Center Room 151. During a 3 p.m. "Speak Out" OCU students can deliver three-minute presentations on how various terrorism prevention strategies may or may not affect civil liberties. Cash prizes will be awarded for the best presentations. The “Speak Out” will be held in Walker Center Room 151.
From 4:00 pm to 6:00pm there will be a screening of "A Conversation on the Constitution: Judicial Independence" featuring remarks by Justices Sandra Day O’Connor, Anthony Kennedy and Stephen Breyer. O’Connor produced and distributed the video to law schools to encourage discussion of the importance of an independent judiciary to the U.S. constitutional system and recent threats to this independence. O’Connor often emphasizes this theme. “Judicial independence does not happen all by itself. It’s tremendously hard to create and it’s easier than most people imagine to destroy,” she said in a recent speech.
The screening will be followed by a panel discussion on judicial independence featuring Judge Charles S. Chapel of the Oklahoma Court of Criminal Appeals, Magistrate Judge Valerie K. Couch of the U.S. District Court for the Western District of Oklahoma and Judge Stephanie K. Seymour of the 10th U.S. Circuit Court of Appeals.
Other sessions will discuss originalism and constitutional interpretation and the relationship between constitutionalism and the criminal justice system. Participants in these sessions include OCU professors Dennis Arrow, Julie Cowgill, Blitz and Johnson.

Oklahoma Lawyers for Children is seeking interested volunteers to attend a one day training session to help abused and neglected children in Oklahoma, Canadian and Cleveland Counties. The training for non-attorney volunteers will be from 8:30 a.m until 2:30 p.m. on Saturday, September 23, 2006 in Room 104 at Sarkeys Law Center which is located on the west side of the Oklahoma City University’s campus at the corner of NW 23rd Street and Kentucky in Oklahoma City.
Oklahoma Lawyers for Children was co-founded in 1997 by D. Kent Meyers and Don R. Nicholson II, both of whom are attorneys in private practice in Oklahoma City to assist the overburdened public defenders in representing deprived children. These children have been removed from their homes due to neglect or abuse by their parent(s) and/or caretaker. Currently OLFC has more than 400 volunteer attorneys, over 180 non-attorney volunteers, as well as legal assistants, mediators, court reporters, private investigators, legal graphic and copy companies, who donate their time, talent, and resources to help abused and neglected children. To date, OLFC volunteers have represented more than 2,263 children in Oklahoma County. The Courts and DHS have recently asked OLFC to assist children in Canadian and Cleveland Counties also.
Volunteers will be trained to conduct Initial Kinship Assessments (home studies) on potential placements for abused and neglected children. The potential placements are usually relatives or those who have a close relationship with the child(ren). During a home assessment, OLFC volunteers go into the homes, complete the necessary paperwork, and submit evaluations to DHS Child Welfare as to the appropriateness of the family for placement of the child(ren). Volunteers usually conduct home assessments in pairs so spouses are encouraged to volunteer, or bring a friend to the training. Training will also focus on the skills involved in interviewing children at the Pauline Mayer Shelter in Oklahoma County, to gather information for the volunteer attorney representing the children at the Show Cause Hearing.
Volunteers will be certified by Oklahoma Lawyers for Children and the Department of Human Services, Child Welfare. You must be at least 21 years of age, have a valid Oklahoma driver’s license, be able to pass a criminal background check, and be willing to help abused and neglected children. Patricia Rogers graduated from OCU LAW in 1999 and is an attorney with McAfee & Taft. Her experience in healthcare includes development of medical staff bylaws for hospitals and ambulatory surgery centers, Medicare fraud and abuse and Stark compliance and analysis, counseling on physician employment arrangements, review and analysis of contracts, advising healthcare clients on EMTALA and HIPAA compliance, developing joint venture arrangements with physicians and other healthcare providers and organizing professional corporations and other professional entities. Rogers assists hospitals, ambulatory surgery centers and other healthcare facilities with issues related to state licensure, Medicare conditions of participation and JCAHO and AAAHC accreditation standards and advises physicians regarding professional licensure standards. Prior to entering law school, she was employed in management positions with healthcare institutions. She served as the coordinator for the Institutional Review Board at an academic medical center and was formerly an active duty and reserve officer in the U.S. Air Force Medical Service Corps.

Guantánamo: How Should We Respond?

Oklahoma City University School of Law joins more than 300 law schools for a televised conference on Guantánamo: How Should We Respond?, a live broadcast that takes an in-depth look at the U.S. government’s detention of suspected terrorists in Guantánamo, Cuba.
The nine-hour broadcast is sponsored by Seton Hall University School of Law and is inspired by the teach-ins of the 1960s. Educators will join journalists, military officers, theologians, human rights activists, detainee lawyers and released detainees in discussing the legal and ethical implications of the controversy surrounding Guantánamo.
Tagged a modern-day teach-in by its sponsors, the program will be carried in 46 states and the District of Columbia. About 80 percent of the nation’s law schools are participating including OCU and the University of Oklahoma College of Law.
OCU School of Law will stage the broadcast in the Homsey Family Moot Courtroom in Sarkeys Law Center. The program is free and open to the public. The program also will be available via high-quality video streams through the Seton Hall Web site.

One of the primary clients at any base is the installation commander, with responsibilities similar to those of a mayor; as a result, the variety of legal problems is virtually limitless. Barrington, OCU LAW JD2004 will share his experience of preparing for the bar exam, the way he marshalled resources that helped him land a job, and how he dealt with unwanted pitfalls. Mr. Barrington established the OCU LAW Texas Legal Society in his first year of law school. And, to provide a longer term perspective, Karen Speegle Badgley, OCU LAW JD1995 and associate with Cozen O'Connor in Dallas, will discuss her transition to the Texas legal market after practicing in Oklahoma for eight years. Oklahoma Court of Criminal Appeals - Hancock v. State

The Oklahoma Court of Criminal Appeals will be at OCU hearing the arguments of Hancock v. State. This is a death penalty case. Following the hearing the judges will meet with students to discuss the issues of the case. Boxed lunches will be provided for student attending the discussion sessions with the judges.

How Do You Deal With Diversity?

There are many issues that can adversely impact how one is perceived in the professional world and in particular those dealing with diversity. How do you deal with diverse issues, especially those that may not be familiar or comfortable to you? Unfortunately, there continue to be examples of uncivil and unprofessional responses to issues surrounding diversity. To help understand the issues the following program has been coordinated. It is open to all students, not just those who would count themselves among the GLBT community. This program will highlight current diversity issues within the legal community, especially those which affect sexual orientation and the GLBT community.
Kenneth D. Upton, an Oklahoma native, moved from Oklahoma City to Dallas in 1997 to head his law firm’s Texas office. In 2002, he became the attorney for and executive director of the Cathedral of Hope, the world’s largest liberal Christian church with a primary lesbian and gay outreach. As the Cathedral’s executive director for three years, Upton gained new insights into the struggles gay and lesbian people still face in achieving civil rights. While there, he participated in the Cathedral’s launch of Hope for Peace and Justice, a faith-based nonprofit organization that strives to equip progressive people of faith to be champions for peace and justice. Upton joined Lambda Legal in 2005, recognizing the opportunities in the south central region to make important inroads toward full recognition of the civil rights of LGBT people. Upton received a juris doctor, with honors, in 1987 from Oklahoma City University School of Law. He graduated magna cum laude with a bachelor of science from Oklahoma City University in 1977.
Richard C. Ogden is a partner with the Oklahoma City law firm of Mulinix Ogden Hall Andrews & Ludlam PLLC. He graduated from the University of Oklahoma College of Law in 1984 and has been an active and productive member of the legal community since. His excellence has been recognized by both the Oklahoma State Bar Association and the Oklahoma County Bar Association as he was named Outstanding Young Lawyer of the Year by both organizations. He also has been an advocate for lesbian and gay lawyers in Oklahoma City and has been instrumental in helping to shape the dialogue for open discussion of diversity issues.

Within a few years after graduation from OCU LAW, M. Keywood Deese was the Conservation Attorney (Senior Oil & Gas Attorney) for the Oklahoma Corporation Commission in the early 1980's. This was during the prior oil boom and before the famous "oil bust." Deese characterizes her time as, "before I turned 30 years old I had the responsibility for 20 oil and gas attorneys, hearing examiners and legal staff. It was thrilling to be at the Commission during those years because of the oil boom and the utility hearings to divide AT&T into the "baby bell" telephone companies. I felt like I was in the "hot seat" for the most important issues in our State at that time." She now serves as Senior Vice President and Trust Officer for Vision Bank N.A. in Ada, Oklahoma, where she uses her business administration degree and her expertise in energy law to manage over $100 million in trust assets including stocks, bonds, real estate, ranches, and mineral management. Deese serves on the board of several nonprofit organizations and conducts estate planning seminars.

Stern, an attorney in Santa Fe, N.M., is one of 19 Americans to reach the summit of Mount Everest this year. He was part of a group of climbers from Russia, Norway, Denmark, Kirgizia, United Kingdom, United States, Philippines and the Netherlands. “I am often asked why I risk so much to climb mountains? Every mountaineer would have a different answer to that question. For me mountaineering is a discipline where the body and mind must work together and every move has to be worked out in terms of effort, balance and consequences,” said Stern in his online journal.

Nuclear Proliferation: How Should the United States Respond?

Today nine countries possess nuclear weapons. The five nuclear weapons states United States, Russia (former Soviet Union), United Kingdom, France and China, are the only countries allowed to have nuclear weapons according to the Non-Proliferation Treaty (NPT). All members of the United Nations except Israel, India and Pakistan have signed the NPT. North Korea withdrew from NPT in 2003, after being labeled as a part of the “Axis of Evil” by President Bush. According to North Korea, the United States had singled it out as a target of a pre-emptive nuclear attack and had threatened it with a blockade and military punishment. It recently performed its first nuclear test.
The NPT gives every member state the inalienable right to use nuclear energy for peaceful urposes. It allows uranium enrichment for fuel purposes. The Bush administration has accused Iran, a signatory of the NPT, of intending to use its nuclear energy facilities to develop nuclear weapons. Iran has repeatedly denied the accusations. On March 6, 2006, Mohamed ElBaradei, Director General of the International Atomic Energy Agency reported that "the Agency has not seen indications of diversion of nuclear material to nuclear weapons or other nuclear explosive devices." On July 2006, the United Nations Security Council passed a resolution demanding that Iran suspend its uranium enrichment activities.
